Acceptance & Eligibility

Section 1 — Agreement to terms and eligibility criteria

Key Provisions

  • TC#1.1 — Acceptance: By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
  • TC#1.2.1 — Age Requirement: You must be at least 17 years of age to create an account.
  • TC#1.2.2 — Legal Capacity: You must have the legal capacity to enter into binding contracts in your jurisdiction.
  • TC#1.2.3 — Accurate Information: You must provide accurate, current, and complete information.
  • TC#1.2.4 — Educational Background: You should have completed (or be completing) academic qualifications relevant to UK admission.

Services Provided

Section 2 — Description of MFF services and plans

Service Plans

  • TC#2.2.1 — Free Assessment (£0): Eligibility assessment, course recommendations, brief counselling, welcome resources.
  • TC#2.2.2 — Basic Plan (£75): 2-4 university applications, personal counsellor, SOP review, document verification.
  • TC#2.2.3 — Premium Plan (£195): 5-7 applications, Double Scholarship, senior counsellor, visa guidance, accommodation, airport pickup.
  • TC#2.3 — Limitations: While we strive for the best outcomes, we cannot guarantee specific admission, scholarship awards, or visa approval as these rest with universities and UKVI.

User Responsibilities

Section 3 — Your obligations as a user

Your Obligations

  • TC#3.1.1 — Account Credentials: Maintain confidentiality of your username and password.
  • TC#3.1.2 — Security Breach: Immediately notify us of any unauthorised access.
  • TC#3.1.3 — Sharing Prohibited: Your account is for single-user use only.
  • TC#3.2 — Information Accuracy: Providing false information or forged documents results in immediate termination without refund.
  • TC#3.3 — Communication: Respond within 7 days. Failure may result in application delays or dismissal.

Payment Terms

Section 4 — Pricing, payment processing, and financial obligations

Fee Structure

  • TC#4.1 — Currency: All fees in British Pounds (GBP), payable in advance.
  • TC#4.2 — Processing: Payments via Stripe (PCI-DSS compliant). We do not store full card details.
  • TC#4.3.1 — Service Connection Fee: £200 may apply for foundation-donor connection (Double Scholarship cases).
  • TC#4.3.2 — Voucher Extensions: £195 per extension, up to 2 extensions allowed.
  • TC#4.3.3 — Reopening Fee: £195 for reopening dismissed applications (refundable if scholarship not secured).
  • TC#4.3.4 — Taxes: VAT inclusive where applicable.

Scholarship Terms

Section 5 — Double Scholarship Programme conditions

Scholarship Conditions

  • TC#5.1 — Eligibility: Exclusive to Premium Plan members. Based on merit, financial need, case-by-case assessment.
  • TC#5.2 — Award Discretion: Awards at sole discretion of MFF and donor partners. Application does not guarantee award.
  • TC#5.3.1 — Direct to University: Funds disbursed directly to university, not student.
  • TC#5.3.2 — Academic Standards: Recipients must maintain satisfactory performance and comply with university regulations.
  • TC#5.4 — UK Compliance: ⚠️ International students cannot receive public funds/donations without UKVI authorisation. Do not disclose donation funding without written UKVI permission.

Refund Policy Summary

Section 6 — Conditions under which refunds are issued

Refund Conditions

  • TC#6.1 — Non-Refundable: Plan fees non-refundable once application begins.
  • TC#6.2.1 — Service Failure: Refund if MFF cannot deliver promised services.
  • TC#6.2.2 — Pre-Application: 3-5 day window if application not yet started.
  • TC#6.2.3 — Voucher Failure: Plan fee + additional payment refunded within 2-3 weeks if MFF cannot facilitate.
  • TC#6.2.4 — Reopening Fee: £195 refundable if scholarship/foundation support not secured.

User Conduct & Prohibited Activities

Section 7 — Rules governing user behaviour

Prohibited Activities

  • TC#7.1.1 — Fraudulent Behaviour: No false information, forged documents, or fraudulent academic records.
  • TC#7.1.2 — Misuse: No unlawful purposes or violations of any laws.
  • TC#7.1.3 — System Abuse: No unauthorised access attempts, hacking, or security interference.
  • TC#7.1.4 — Impersonation: No impersonating others or misrepresenting identity.
  • TC#7.1.5 — Spam/Harassment: No spam, staff harassment, or abusive behaviour.
  • TC#7.1.6 — IP Violation: No copying, reproducing, or distributing MFF content without permission.
  • TC#7.2 — Consequences: Violations result in immediate termination, fee forfeiture, and possible legal action.

Intellectual Property

Section 8 — Ownership of content and materials

IP Provisions

  • TC#8.1 — MFF Property: All website and portal content (text, graphics, logos, software, design) is MFF property, protected by UK and international copyright laws.
  • TC#8.2 — Limited Licence: We grant you a limited, non-exclusive, non-transferable licence for personal, non-commercial use only.
  • TC#8.3 — User Submissions: You retain ownership of submitted content but grant MFF a non-exclusive licence to use it for service delivery.

Disclaimers & Limitation of Liability

Section 9 — Limits on MFF's legal responsibility

Liability Limits

  • TC#9.1 — As Is: Services provided "as is" without warranties of any kind.
  • TC#9.2 — Limitation: MFF not liable for: indirect/consequential damages, loss of opportunity or profits, third-party services issues, student-caused delays, incorrect user information.
  • TC#9.3 — Maximum Liability: Total liability capped at amount paid to MFF in preceding 12 months.
  • TC#9.4 — Third-Party Decisions: Universities, donors, and UKVI decisions are independent and not controlled by MFF.

Termination

Section 10 — Conditions under which the agreement may end

Termination Rights

  • TC#10.1 — By User: Terminate anytime via support@myfinancefoundation.com. No refund unless eligible.
  • TC#10.2.1 — Breach: Immediate termination for violation of Terms or policies.
  • TC#10.2.2 — Fraud: Termination for suspected fraud, misrepresentation, or illegal activities.
  • TC#10.2.3 — Inactivity: Free accounts: 15-day upgrade deadline.
  • TC#10.2.4 — Non-Payment: Failure to pay applicable fees.
  • TC#10.3 — Effects: Access ceases; some information retained for legal/business purposes.

Governing Law & Disputes

Section 11 — Legal framework and dispute resolution

Legal Framework

  • TC#11.1 — Governing Law: Laws of the United Kingdom apply.
  • TC#11.2 — Jurisdiction: Exclusive jurisdiction of UK courts for any disputes.
  • TC#11.3 — Dispute Resolution: Good-faith resolution attempt with support team first. 30-day window before formal action.
  • TC#11.4 — Consumer Rights: Nothing limits your statutory consumer rights under UK consumer protection laws.

Modifications & Contact

Section 12 — Changes to terms and contact information

Final Provisions

  • TC#12.1 — Modifications: Changes notified via email and website. Continued use = acceptance of new Terms.
  • TC#12.2 — Severability: Unenforceable provisions don't affect remaining Terms.
  • TC#12.3 — Entire Agreement: These Terms + Privacy Policies = complete agreement.
